Court Cases Involving Common Core:
1.David Adams vs Kentucky Education Officials- Unsuccessful
David Adams, a parent from Nicholasville, KY, filed a lawsuit against the Governor Steve Beshear, Senate President Robert Stivers, the Kentucky Board of Education, Council on Postsecondary Education and Lawrence County Board of Education for “for declaratory and injunctive relief relating to Defendants’ acceptance of Common Core State Standards.” 1
Kentucky judge has thrown out the nation’s first lawsuit against Common Core, saying Adams had no standing to bring the suit and did not demonstrate a “unique, personal injury.” 2
The Kentucky Court of Appeals dismissed TEA Party activist David Adams' appeal of his unsuccessful anti-common core suit.
2. Bobby Jindal vs U.S. Department of Education- Outcome: Pending
-Louisiana Governor Bobby Jindal has joined a lawsuit against the state's education officials alleging that they violated the law when they implemented the federal Common Core standards.
According to the case initiated by legislators, the state's education agencies failed to publicly advertise the standards before putting them in place, denying parents and community members their right to review and comment on them. 3
-Specifically, Governor Jindal has accused the Obama administration of illegally persuading Louisiana and other states into adopting a national curriculum through Common Core by tailoring the requirements for federal education grant money and waivers to those particular academic standards.
-4 years ago, Jindal pushed for Louisiana to adopt Common Core, but has turned against the standards in recent months. According to national polls, Common Core has grown increasingly unpopular, particularly with political conservatives who view it as a federal intrusion.
-Education experts have said Jindal's Common Core lawsuit is unlikely to succeed. The courts have sided with the federal government in similar legal disputes over education policy in the past.
-No decision yet: Federal judge Shelly Dick has put off making a ruling on Gov. Bobby Jindal's lawsuit against President Barack Obama over the Common Core academic standards until after Dec. 12th. 4
